File A Mechanics' Lien
A Mechanics' Lien is a claim against real estate made by a contractor, subcontractor,
or supplier of building materials who contributed to improvements on the real estate.
For example, if you, as a subcontractor, were not paid for work you performed on
a construction project you would file a Mechanics' lien against the property, also
naming the party who did not pay you in the Lien filing. A Mechanics' Lien is your
best first option for getting paid, as it "clouds" the title, preventing sale or
refinancing. It is also inexpensive and gives you leverage in dealing with the opposing
parties.
It is imperative that the filing deadlines met and your documentation be accurate
or your Mechanic’s Lien will be determined to be not valid. Filing deadlines are
as follows:
New York: Commercial property- any time during the progress of the work and the
furnishing of the materials, or within eight months after the completion of the
contract, or the final performance of the work or the final furnishing of the materials.
Residential properties- the end period is four months instead of eight.
New Jersey and Connecticut-any time during the progress of the work and the furnishing
of the materials, or within three months after the completion of the contract, or
the final performance of the work or the final furnishing of the materials.
In addition to the property address and owner the lot and block number of the property
are required. The property owner and contractor must be informed that a Lien has
been placed on the owner’s property due to lack of payment.
